Car Accident

It was a sad day on June 9th, 2016, when I was involved in a car accident. Unfortunately, my 2012 Sport was totaled out due to the extent of the damage and cost to repair it. You may have seen my post on the Facebook Fusion groups. Was able to walk away with only minor injuries. The safety features did an awesome job - Built Ford Tough!! The replacement will definitely be another Ford! I will stay and support the community.

Sorry about the car, but as stated already, the important thing is that you escaped with minor injuries. Modern cars are remarkably safe. I laugh when people day that they don't make them like they used to.. Thank goodness they don't. In another era, you might not have walked away from this unscathed.

 

What happened anyway?

Thank you drolds1. My apologies as I'm not a moderator. I did a copy and paste from my post over at the Ford Fusion Club forum, where I am a moderator there. I wouldn't mind being a moderator here in this forum, if it's allowed. I've edited my post.

 

Here's what happened - the Honda Accord driver made a left turn as I entered the intersection. We both had the green light and she was stopped as I approached as she had to have seen me coming. Apparently, she was "distracted" by "looking down", more than likely at her phone, which she said to my kids while she crying and apologizing. When the police officer asked her what happened, all she could say was "I don't know..." On top of it all, when asked to provide proof of insurance, she didn't have it and neither did her mom, who arrived after the accident happened. Her mom is the registered owner of the Accord.

 

Last Friday late afternoon, I received a phone call from my insurance (State Farm) and they informed me that the girl who caused the accident is covered by them and has accepted 100% responsibility for causing the accident. I will be getting my $250 deductible back. Also, the following purchase was made last Friday night:

Wow! Beautiful truck, beautiful color.

 

I'm glad to hear that she accepted full responsibility. That removes any hassles for you. This is why I've installed a dashcam in my car.

 

No worries about the moderator thing. If you'd like to become a moderator, PM Robert Lane and ask. We can always use another experienced voice. ;)

There isn't much else she could say other than if a left turn arrow existed and she claimed she had the arrow and you had a red light. If there were witnesses or there wasn't a left turn arrow at that intersection then she had no leg to stand on anyway.

 

It is good to hear some take responsibility though.

Thank you! A dashcam is definitely going to be an investment. Which one do you have? I'm friends with Robert on FB. I'll ping him there.

 

There isn't much else she could say other than if a left turn arrow existed and she claimed she had the arrow and you had a red light. If there were witnesses or there wasn't a left turn arrow at that intersection then she had no leg to stand on anyway.

At the accident scene, hearing the police officer tell me that she or her mom could not provide proof of insurance added further insult to injury. I was very happy to hear that they were covered by State Farm and even more so that she took responsibility in causing the accident. Court date is 7/21 and her lack of proof of insurance ticket will be thrown out. The "improper left turn" ticket will still stand. And the fact that she caused the accident, it'll be interesting to see what the outcome will be.

If it's her first offense she'll probably be given an option to attend a class, write a paper and probably take a defensive driving class and if completed the ticket would be wiped off her record - or at least not incur any points. That's what they did for my daughter when she wasn't paying attention and rear ended another vehicle, totaling her 6 month old Focus HB and an older Corolla (no injuries). In her group there were 10 or 12 other teens with the exact same ticket - following too closely.

The girl is currently 18 year old and her mom did say that they recently bought the car. I'm sure I'll find out next month in court what she'll get.

 

KDLinks Dashcam as used by macbwt (Edge forum). You can see his videos up on YT at MACTFORDEDGE, or join his FB community and talk to him that way. He puts a lot of miles on his Edge, so he should know by now if it works or not LOL.

Is court mandatory for a traffic accident in IL or is that for the not carrying proof of insurance citation?

I'd have to say "yes", it's mandatory. Here's why based on a what a local attorney stated:

 

"You need to go to court because you are what is called the Complaining Witness. Because the police officer was not there and did not see the accident, he cannot testify to what the defendant has done or failed to do. You will need to be present in order to prove the State's case against the driver. Without you, the case will be dismissed or a not-guilty will likely be entered if the other driver decides to plead not guilty to the charges..."

Years ago, I was hit by a fire truck on its way to a fire. A cop arrived after the fact and gave me a ticket for failure to yield right of way. How he could do this was a mystery to me. I pleaded 'not guilty' and won my case.

No kidding. A firefighter called the cops and the cop, who witnessed nothing, handed me a ticket while I was sitting in the back of an ambulance waiting to go to the ER! Talk about adding insult to injury (I wasn't seriously hurt). This seriously pissed me off because years earlier I was a passenger in a car driven by my brother and we were hit head on by a driver that completely crossed over the yellow line to pass a bus. When the cop arrived, he refused to ticket that driver because he hadn't witnessed the accident.

 

At the time, I knew someone at work who was an EMT/ambulance driver. He had all the vehicle and traffic regs. at hand and schooled me on NY law WRT emergency vehicles at controlled intersections. Contrary to what you might think, in NY at least, they are not permitted to blast through red lights. They are required to make sure that the intersection is clear before proceeding. I was already more than halfway through the intersection. Pictures of the damage to my car were able to verify that. The firefighter who had been sitting behind the driver testified in court. I was allowed to question him after the referee did was able to blow holes in all his testimony. For example, he testified that I was speeding, which was impossible on that particular street which was full of deep potholes after a record-breaking winter. At that point, I asked him what kind of device he used to clock my speed. Of course, he couldn't answer that. (Ya gotta know the law). After seeming to have total recall of every minute detail, he "couldn't remember" what color light they had. Thankfully, the case was dismissed at that point.

My son had a fender bender in Seattle with a cop car (cop hit him). Fortunately it was witnessed by another cop who offered to testify so the cop who hit him "copped" to it and he didn't have to fight it. But I wonder what would have happened if the other cop wasn't there.

Pretty sure emergency vehicles are required to check for a clear intersection everywhere before running a red light or stop sign.

 

My son had a fender bender in Seattle with a cop car (cop hit him). Fortunately it was witnessed by another cop who offered to testify so the cop who hit him "copped" to it and he didn't have to fight it. But I wonder what would have happened if the other cop wasn't there.

 

Wow, Allen. Around here the other cop would swear in court that your son hit the cop car.

 

Once again, that's why you need a dash cam.

Seattle is a different place. They even park differently. When there is diagonal parking on the street where we would pull in and then back out, in Seattle you have to go past the space and back in. Then when you leave you just pull out. It's actually much safer.

 

They also have tons of bikes and they all drive 35 mph everywhere. My son hasn't owned a car in 3 years - he just rides the bus everywhere 24/7.
